What is Conveyancing?

Legal Process for Property Transfer

The Conveyancing Process is the legal mechanism for the transfer of property between parties. Legal checks, public record review, contractual drafting, negotiation and receiving detailed, relevant advice are all critical to ensure that your rights are protected in any Property transaction.

When do I need Conveyancing?

Depending on your status as a vendor or purchaser, the Conveyancing Process will typically start after the parties agree on a price and execute a signed contract. We always advise that best practice is to engage with your advisors early to ensure that you best protect your interests before you do a deal.

Conveyancer or Solicitor?

Both Solicitors and Licensed Conveyancers can manage the Conveyancing Process, however lawyers can provide you with considered legal advice which takes account of your circumstances beyond the formal process.

  • AML/CTF Due diligence and client onboarding.
  • Preparation of a Contract for Sale, including collating all necessary statutory documents.
  • Drafting of appropriate special conditions to protect and enforce your rights.
  • Provide written advice to you about obligations under the contract.
  • Issue completed contracts to you and your selling agent.
  • Advise and assist in negotiations with purchasers or vendors.

Exchange

  • Ensure contracts are validly executed and exchanged.
  • Liaise with any parties with a beneficial interest, such as for mortgagee discharge on settlement.
  • Review adjustment calculations for council rates, water rates and other relevant statutory authorities.
  • Provide purchasers with payment directions per your requirements.
  • Review and advise on settlement calculations from purchasers.

  • Having managed the process in conjunction with the other parties throughout the transaction, complete your settlement electronically using Australia’s online property exchange network 'PEXA'
  • Ensure all settlement documents are correct and valid.
  • Ensure all settlement funds are paid to the relevant parties on discharge.
  • Advise you once settlement is successfully completed.
